videography, livestreaming, post-production, and app-based booking—and outlines your rights

regarding that information. It is intended to be enforceable and admissible under both United

• Content delivery via digital galleries or cloud services

• Scheduling via our mobile booking platform

All provisions outlined herein apply equally to any type of service performed under the

Photomochi Studio name, whether in-person, remote, or via digital platforms.

a. Information You Provide Directly

• Name, email, phone number, address, company name• Booking dates, event type, location details

• Editing or content instructions

• Audio/video/photo data submitted or captured during service

• IP address, browser type, device identifiers

• Usage logs of our app and website

• GPS or location data if enabled

• Metadata related to uploads and usage

3. Use of Information

We use your data only for the legitimate business purposes of:

• Booking, planning, and executing your service

• Delivering edited content

• Verifying payments and handling transactions

• Ensuring service quality and improving user experience

We do not sell your data.

4. Media Capture Liability and Client Responsibility

By booking any service with Photomochi Studio, the Client acknowledges and accepts full

legal responsibility for ensuring all individuals being photographed, filmed, or recorded

(audio and/or video) have given proper permission to be captured.

a. Consent WaiverBy engaging our services, you (the Client) warrant and represent that:

• You have obtained all necessary permissions, releases, or consents from participants,

guests, employees, or individuals present at your shoot location.

• You release Photomochi Studio from any and all legal liability, claims, or damages

arising from the use, capture, or public presence of any visual or audio media.

• You agree to indemnify and hold harmless Photomochi Studio and its affiliates against

any third-party claims related to unauthorized recording, appearance, or use of media.

b. Photomochi Studio Rights

We retain the right to capture, store, and edit any visual or audio content required for delivering

the agreed-upon service. Unless specifically opted out in writing, we may use select works in our

professional portfolio, press, or promotional materials, with authorship and credit properly

attributed to Photomochi Studio.

5. Data Sharing and Security

Your information is only shared:

• With our vetted contractors for service fulfillment

• With payment processors (e.g., Stripe, PayPal)

• With cloud platforms for content delivery (e.g., Google Drive)

• With legal authorities when required

We use modern security protocols including SSL encryption, account access control, and routine

monitoring to protect your data.

6. Retention and Deletion

Data is retained only for as long as necessary to deliver the service or meet legal obligations.

Clients may request deletion of personal data by emailing showtime@photomochi.com. Some

content may be retained for archival or legal purposes if permitted by law.

7. Your Rights (California Residents)

Under CCPA and CPRA, California residents have the right to:• Know what data is collected and why

• Access their personal data

• Request deletion of data (with some legal exceptions)

• Opt out of data sales (Photomochi does not sell data)

revised terms.
