Terms and Conditions

These Terms and Conditions (“Agreement”) govern all services provided by Photomochi Studio

(“Photomochi,” “we,” “us,” or “our”), including photography, videography, livestreaming,

editing, and all related creative services booked through our mobile app, website, or any official

communication channel. By booking services, accepting deliverables, or interacting with our

business operations, you (“Client,” “you,” or “your”) agree to be legally bound by this

Agreement. These terms are enforceable under United States federal law, the laws of the State of

California, and generally applicable throughout all U.S. states and territories.

1. Scope of Services

Photomochi Studio offers a wide range of visual production services for personal, commercial,

and corporate purposes. Each service package includes a fixed and pre-defined scope of

deliverables. Once a booking is made and confirmed with full payment, the contents of the

service package are final. Clients may not alter the contents of their package post-purchase. If

additional services or deliverables are required, clients must make a new, separate booking to

obtain them.

2. Cancellations and Refund Policy

Clients may cancel a booking within twenty-four (24) hours of placing the order to receive a full

refund. After the initial 24-hour window, all bookings become final and non-refundable.

Photomochi Studio does not offer rescheduling. If clients wish to change the time or date of their

session, they may cancel within the allowed window and create a new booking.

3. Overtime Charges

If a session exceeds its originally scheduled duration, overtime fees will apply at a rate of $250

per hour. These fees are invoiced separately and must be paid outside the mobile app or booking

system. No photos, videos, or any other content will be released until all applicable overtime

charges are paid in full.

4. Client Responsibility for Consent and Usage

Clients are fully responsible for securing all necessary permissions, releases, and legal consents

from any individuals, property owners, or venues involved in the shoot. By confirming a

booking, the Client warrants that all parties who may appear in photographs, video, or audio

recordings are aware of and have consented to being recorded. The Client also assumes full legal

responsibility for compliance with local, state, and federal privacy or recording laws at the shoot

location. Photomochi Studio will not be held liable for any claims, disputes, or legal actions

arising from a lack of authorization, consent, or permission related to recorded media.

5. Deliverables and Timelines

Edited photographs will be delivered to the Client within forty-eight (48) hours of the shoot date.

Edited video content will be delivered within seven (7) calendar days. These delivery times are

dependent upon the timely receipt of all client-provided editing instructions, brand assets, and

any materials necessary to fulfill the project. Photomochi Studio is not liable for delays caused

by a client’s failure to supply this required information.6. Editing and Revisions

Photomochi Studio does not offer revisions beyond the initial delivery. Clients must submit all

creative direction, editing instructions, or visual preferences in advance by emailing

showtime@photomochi.com. The studio retains full discretion over stylistic, creative, and

editorial decisions during the editing process. All final deliverables are considered conclusive.

7. Intellectual Property and Rights

Photomochi Studio retains full authorship, copyright, and intellectual property ownership of all

creative works produced. Upon full payment, the Client is granted non-exclusive commercial

usage rights to use the content for their own purposes. Clients may not resell, license, sublicense,

or redistribute the media without prior written consent. Unless the Client opts out in writing,

Photomochi Studio reserves the right to use selected deliverables in its own promotional

materials, digital portfolio, or media outlets, including those used in public relations, advertising,

or award submissions.

8. Talent Assignment and Availability

Photomochi Studio selects the appropriate team members based on internal logistics,

specialization, geography, and project needs. Clients may not request or choose specific

individuals for their shoot. All assigned photographers and videographers are thoroughly vetted

and trained to meet Photomochi Studio’s high standards of professionalism and quality.

9. Emergencies and No-Shows

In the rare event that a photographer or videographer fails to appear for a session due to a

verifiable emergency or a force majeure event, Photomochi Studio will issue a full refund to the

Client. No further compensation, liability, or responsibility shall be extended beyond the original

booking fee.

10. Service Areas and Custom Bookings

Photomochi Studio currently operates within limited regional service zones as listed on the app

or website. If a Client attempts to book from a location outside the supported regions, they may

contact showtime@photomochi.com to request a custom or manual booking. Likewise, if a

Client’s project falls outside the scope of existing packages, a custom arrangement may be

created through direct consultation.

11. Limitations of Liability

To the fullest extent permitted by applicable law, Photomochi Studio shall not be liable for any

incidental, consequential, punitive, or indirect damages arising from the use of our services or

failure to meet subjective client expectations. We are not responsible for weather conditions,

client lateness, interruptions, equipment malfunctions, or any condition that prevents full

execution of a session beyond our control. Our total liability in any circumstance is strictly

limited to the amount paid for the booking in question.

12. Client Responsibilities Regarding Parking, Permits, and Legal Documentation

The Client is solely responsible for securing any required parking for Photomochi Studio’s

assigned photographers or videographers at the shoot location. This includes access to a legal,

safe, and reasonably close parking spot that allows for proper unloading, setup, and timely

service delivery. If parking is not provided and the assigned professional is delayed or unable to

reach the location, Photomochi Studio will not be held liable for incomplete services or delays.

The Client is also solely responsible for acquiring all location-specific permits, licenses, or

permissions necessary for photography, videography, or audio recording. This includes municipal

film permits, venue authorizations, or any applicable insurance documentation. Photomochi

Studio is under no obligation to sign client-generated contracts, NDAs, or agreements, and may

decline service if such documents are requested. We are not required to provide certificates of

insurance, legal documentation, or business licensing details unless mandated by law or

otherwise agreed upon in writing by an authorized Photomochi Studio representative.

13. Dispute Resolution and Legal Venue

This Agreement is governed by and construed in accordance with the laws of the State of

California. Both parties agree to attempt good-faith negotiations prior to initiating any formal

legal action.

14. Updates to Terms

Photomochi Studio reserves the right to amend, update, or modify these Terms and Conditions at

any time without prior notice. Any continued use of our services following such changes

constitutes acceptance of the revised Agreement.
